1) Who we are

2) Purpose of the CGU/CGV

These terms and conditions govern access, browsing and use of the Site, as well as the sale and/or direct supply by At Marrakech of the services presented on the Site (e.g. reservations, experiences, events, editorial content, associated digital services). By accessing the Site, you fully accept these T&Cs.

3) Nature of services and contractual framework

  • At Marrakech designs, publishes and operates content and offers its own services described on the Site.
  • Any order/registration made via the Site forms a direct contract between you and At Marrakech; the particular conditions specified at the time of the order complete the present.

3 bis) Partner services & affiliation

  • The Site may contain third-party offers (activities, hammams/spas, excursions, accommodation, transfers) offered through partner platforms or by local establishments.
  • When you click on «See the offer» / «Book online» and are redirected to a third-party website, the contract is then concluded directly between you and the third party. The terms and conditions, cancellation/refund policies and rules of that third party apply and prevail.
  • At Marrakech is not a party to the contract with the third-party provider and does not collect payments when the booking is finalized on the partner's website. We may collect a affiliation fee at no extra cost to you.
  • We remain available for facilitate exchanges (by way of assistance), without replacing the third-party service provider's legal obligations.

4) Information, availability and accuracy

  • We make every effort to keep our information accurate and up-to-date. However, changes (schedules, rates, programs, shows, menus, availability) may occur.
  • Visuals (photos/videos) are for illustrative purposes only.
  • In the event of any discrepancy between an information page and an order summary, the summary shall prevail.

5) Accounts, logins and communications

  • When a customer area is offered, you undertake to provide accurate data and to keep your identifiers confidential.
  • You agree to receive communications from us by email, telephone or messenger (e.g. WhatsApp) relating to your requests, confirmations, reminders, feedback and similar offers (opt-out possible at any time).

6) Prices, payment and invoicing

    • Prices are indicated in MAD, Euros and US Dollars; all taxes included when VAT is applicable (or specified where applicable).
    • Accepted payment methods are displayed at the time of ordering (e.g. credit card, bank transfer, on-site payment, payment links).
    • An invoice can be issued by At Marrakech on request or automatically depending on the service.
    • Banking and exchange fees may apply, depending on your bank.

    • Currency conversions displayed (e.g. 1 € ≈ 11 MAD) are indicative amounts actually debited may vary according to your bank's/issuer's rates and charges.

  • For reservations finalized at a partner, The payment is processed by this partner, according to its own payment methods and policies. At Marrakech does not access your credit card information.

7) Cancellation, modification and no-show conditions

    • Cancellation and modification rules are specified for each service when you place your order and in your confirmation.
    • In the event of a no-show, a fee may be payable in accordance with the posted conditions.
    • Refunds, when provided, are processed by At Marrakech according to the same terms and means of payment as the original order, unless technically impossible and justified.

  • For reservations made with a third-party provider, cancellations, modifications, no-shows and refunds are governed by the partner conditions (displayed at the time of booking on its website/app). At Marrakech is not responsible for the service provider's decisions or refund times.

8) Content, opinions and contributions (UGC)

  • You can publish authentic and legal reviews, notes and photos. The following are prohibited: defamation, insult, incitement to hatred or violence, illicit content, counterfeiting, infringement of image rights.
  • You declare that you own the necessary rights to your content.
  • You grant At Marrakech a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt and distribute such content on the Site and our channels for the legal term of protection.
  • We may remove/modify any non-conforming content without notice.

9) Prohibited use of the Site

It is forbidden: (i) to hinder the operation of the Site (malware, overloading, security bypass), (ii) to extract or reuse data on a massive scale, (iii) to usurp an identity, (iv) to use the Site for illegal or fraudulent purposes.

It is also forbidden to use robots, scrapers, spiders, crawlers or any automated process to access, collect or index our pages, content, databases or availability calendars in an unauthorized manner.

10) Intellectual property

  • The Site, its texts, graphics, logos, videos, codes and databases are protected by intellectual property law.
  • Any reproduction or reuse beyond strictly personal use is prohibited without written authorization from At Marrakech.
  • The trademarks and distinctive elements of At Marrakech may not be used without prior consent.

11) Programs, shows and visuals

  • Shows/entertainments (e.g. live band, Gnawa, dance, DJ) and menus are subject to change. The information provided at the time of order/confirmation takes precedence.
  • The photos are indicative and do not constitute a contractual commitment.

12) Responsibilities

    • The Site is provided «as is». We do not guarantee the absence of errors or uninterrupted access.
    • At Marrakech's liability for direct damages is limited to the amount paid by the User for the service in question.
    • At Marrakech is not liable for indirect damages (loss of profit, loss of opportunity, loss of reputation) or damages resulting from misuse of the Site or non-compliance with the GTC/CGV.

  • For services booked with third party (partner platforms, establishments), At Marrakech assumes no responsibility for the performance of the service, changes in schedules/programs, cancellation by the third party, access policies (age, dress, security), or incidents occurring during the service. Your recourse lies with the service provider concerned.

13) Force majeure

Neither party shall be liable for failure to perform due to an event of force majeure (natural disaster, health crisis, administrative decision, breakdown, public disturbance) making it temporarily impossible to perform the obligations.

In Marrakech and in the Agafay desert, certain activities are available. weather-dependent (wind, rain). Last-minute adaptations/cancellations may be made for safety reasons.

14) Personal data & cookies

    • Your data is processed by At Marrakech in accordance with Moroccan law, in particular law no. 09-08. The purposes, retention periods, rights and methods of exercising them are set out in our Privacy Policy. Privacy Policy.
    • The Site may use cookies/trackers (audience measurement, preferences, functionalities) in accordance with our Cookies Policy. You can manage your preferences at any time.

  • From cookies/affiliate URL settings can be used by our partners to allocate reservations correctly, at no extra cost to you.

15) Safety

We deploy reasonable measures (technical and organizational) to protect the Site and your data. However, no online service can guarantee absolute security.

16) Customer service and complaints

    • Complaints concerning an order must be sent with your references (order number, date, service, receipts) to facilitate processing.

  • For a service booked with a partner, Please also contact the customer service department of the service provider indicated on your confirmation.

17) Applicable law & jurisdiction

  • These terms and conditions are governed by Moroccan law.
  • Any dispute relating to the validity, interpretation, performance or termination of the contract shall be settled by the courts of Marrakech, subject to mandatory jurisdiction more favorable to the consumer.

18) Modifications to the GCU/CGV

We may update this document for legal, technical or organizational reasons. The date at the top of the document is authoritative. Continued use of the Site implies acceptance of the modified GCU/CGV.

19) Partial nullity

If a clause is found to be invalid, the other provisions remain in force. The invalid clause will be replaced by a valid clause reflecting the original intent.
